Terms & Condtions

1. General:

Unless otherwise agreed in writing these conditions constitute the only conditions upon which George Fry Ltd (The Company) are willing to supply the goods to any person wishing to purchase goods (The Purchaser) from the Company. All orders are accepted and executed on the understanding that the Purchaser is bound by these conditions. These conditions shall prevail over any terms and conditions in the Purchasers order or other document issued by the Purchaser except where expressly agreed to by the Company in writing. 

2. Prices:

All prices are executed subject to the quoted price which shall supersede any pricelist of the Company whether published or unpublished.

3. Availability:

If the items ordered are not in stock, Customers will be informed via e-mail or telephone. Customers reserve the right to cancel an order placed on items not in stock if unsatisfied with the delivery alternative.

Items that are newly released on pre-order will be dispatched at the earliest opportunity. Stock items which are ordered with the new release items can be delivered to the Purchaser at an extra charge if required.

4. Goods supplied by the Company shall be at the Purchasers risk immediately on delivery to the Purchaser or in custody on the Purchaser's behalf.

5) Warranty:

The Purchaser is entitled to the benefit of any warranty or guarantee received by the company from the Manufacturer of goods supplied.
The company shall not be liable for:

i) Any defects resulting from wear and tear, accident, improper use by the Purchaser other than in accordance with the instructions or advice of the Company or the Manufacturer of the goods.

ii) Suitability of any goods for any particular purpose or use under specific conditions whether or not the purpose conditions were known or communicated to the Company.

iii) Any technical information, recommendations, statements or advice furnished by the Company or its servants not given in writing in response to a specific request from the Purchaser before the contract is made.

In the event of any faults arising during the guarantee period:

a) The Purchaser shall be responsible for the return of all faulty goods in its original packing or suitably packed to the Company.

b) The Company reserves the right to carry out the repairs itself, its agents or return the goods for repair to the Manufacturer as the Company in its absolute discretion sees fit.

Where the goods are sold under a Consumer Transaction (as defined by the Consumer Transactions (Restrictions of Statement) Order 1976) the statutory rights of the Purchaser are not affected by these conditions.

6) Return of goods:

A handling charge of 25% will be deducted from the invoice value by the Company where it is established that the reason for return of the goods was not subject to provisions of clause 5 of these Conditions or through any error on the part of the Company. All goods must be returned in their original packing.

7) Claims:

Claims for missing items, non-delivery or damage to goods in transit must be made within 7 working days of expected delivery time. Any claims made after this time will not be accepted.

8) Dead on arrival:

Any new goods that are found to be faulty maybe returned for replacement or a refund in which case the Purchaser has to notify George Fry Ltd within 7days of the receipt of goods. All goods must be returned in their original packaging.

9) Payments:

We accept the following cards ACCESS, DELTA, MASTERCARD, SOLO, SWITCH, ELECTRON and VISA. We deliver only to the card holders billing address.

We reserve the right not to proceed with the order if we are unable to verify security details such as the billing address. We may ask the customer to supply proof of address in such cases.

Your credit or debit cards will be charged at the time of ordering in order to secure the goods.

Cheques both personal and business are welcome but will require clearance before shipment of any goods takes place. Clearance will take up to 7 working days from when cheque is received.

Funds may also be transferred directly into our bank account (or pay cash) in such cases goods will be dispatched as soon as the funds have cleared. Special clearance of cheques will be subject to a £15 charge.

No title of goods shall pass from George Fry Ltd to the Purchaser until Payments have been received in full. The Purchaser has full responsibility for the goods from the time of delivery and liability to insure that the goods then rest with the Purchaser. 

10) All products are subject to availability.

11) All products are covered by a one year's Manufacturer's warranty unless otherwise stated.

12) Where free additional warranties are offered, they will be subject to the purchaser registering the purchase with the appropriate manufacturer unless otherwise stated.

13) Goods are not supplied on a trial or rental basis.

14) All displayed and advertised prices are inclusive of VAT at the prevailing rate unless otherwise stated.

15) We assume that our Customers are aware of the functions and compatibility of products and are competent in setting up the equipment bought from us. Customers who are unsure about the functions and are less knowledgeable about the products are free to contact us.

17) Re-delivery of goods after failed delivery where George Fry Ltd or their couriers are not at fault may require re-delivery and /or return delivery charges.

18) George Fry Ltd reserves full rights to cancel an order if not fully satisfied with any security criteria. George Fry Ltd defines cleared orders as orders that have cleared funds and passed security checks fully.

19) All product descriptions and illustrations which are featured in our advertisements, web sites and brochures are correct at the time of going to press or in the case of web pages, the web site going 'live.' If there are any changes to products Purchasers will be notified when ordering by mail order.

20) The following terms and conditions apply to mail order Consumers as defined in the Consumer Protection (Distance Selling) Regulations 2000.

The Purchaser shall, according to the terms set out in this clause, have the right to cancel an order within 7 working days after the date of delivery by the Company to the Purchaser provided that he or she gives written notice of such cancellation.

i) If the Purchaser cancels a contract, George Fry Ltd shall, according to the regulations refund any payment made by the Purchaser within 28 Days from the day on which He or She cancelled the contract, however that the Purchaser shall not be entitled to a repayment in the event that:

a) The Purchaser does not pay due care and attention of the goods either prior or following the cancellation of the contract whilst the goods remain in the Purchasers possession. The Purchaser shall not be refunded if the goods are not packed in their original box, with all entireties e.g. manuals, cables etc. and if the internal or external packaging has been damaged or misused in any way.
b) The Purchaser marks or damages the goods or returns them in a different condition to what he or she received on delivery.

The Consumer is entirely culpable for the cost of returning any goods to George Fry Ltd. This applies to refund, replacements and repairs.

21) Consequential loss:

a) The Company shall not be liable for any loss sustained by any personal damage to any property whatsoever and howsoever arising directly out of or in consequence of any act or a mission by the Company in the supply of goods including delay, loss of profit and liability to third parties.

b) Nothing contained in these terms and conditions shall affect the Companies liability under the 'unfair contracts terms act 1977' for death or personal injury caused by the negligence of the Company.

22) This contract and these general conditions of sale shall at all times be construed in accordance with and subject to jurisdiction of the courts in England.

Please note that in addition to the above when making contact with George Fry Ltd all calls are recorded  for training and monitoring purposes and all emails received will be kept for a period of time relevent to the subject about which it has been raised.

Your Data.

George Fry Ltd is/are a member of Combined Independent (Holdings) Ltd, and many of the products available through our business are supplied to us via CIH Ltd. We also advertise and sell products under the euronics brand identity. When you shop with us, and purchase any product or service offered by us via CIH Ltd, we will share limited data with CIH Ltd and this may include any or all of the following; name, address and order details, email address and telephone number. This data is used for experience, analytics and marketing purposes only, including services provided by 3rd parties used by either ourselves and/or CIH Ltd and via our website and/or euronics.co.uk. Such services could include, but are not limited to; user journey and site analytics, reviews platforms, marketing mailings and newsletters, service emails and safety and product recall information.

Delivery Timescales.

George Fry Ltd will deliver all purchased goods within a window of 5 days. George Fry Ltd will contact all customers immediately after a sale has been made to confirm the delivery details.

Click and Collect

Click & Collect is available on selected products from our main store. George Fry Ltd will email you when your order is ready for collection. George Fry Ltd will hold your order for 3 days. If your order is not collected within this time your order will be refunded by George Fry Ltd. Please be aware that a restocking fee of £0.00 will apply.

When collecting your order from our main store you must bring a form of identification with you; the payment card used for the order or a current photographic drivers license or passport. Without a form of ID we are unable to release your order.

This site is only intended for use by, and orders will only be accepted from, residents of the United Kingdom of Great Britain and Northern Ireland. We cannot commit that product(s) supplied are suitable for use in any other regions.

Placement and processing of orders

If you wish to buy product(s) through this site then you should follow the procedure specified in this site.

After placing an order, and once payment has been authorised, you will receive a sales confirmation via email acknowledging that your order has been received by George Fry Ltd.

Acceptance of your order will be made which confirms that the product(s) you have ordered are available for delivery.

The contract between you and George Fry Ltd will only be formed when a sale confirmation is sent to you and payment has been received.

George Fry Ltd will confirm that your chosen product will be delivered on certain date and request that this is acceptable.

Cancellation

If you wish to cancel your order, this will need to be done by 12pm the working day prior to your delivery date (Mon-Fri), or delivery will be made. Any returns after this time will be liable for a collection charge.

You will be informed as soon as possible if for any reason product(s) ordered by you are not available for supply. Where you have already paid for the product(s), you will then be issued with a full refund or an alternative product.

Consumer Rights

If you are ordering product(s) as a consumer you may cancel the contract at any time within a fourteen working day "cooling-off" period, beginning on the day after the day you receive the product(s) (the required post contractual information will be supplied in an email confirming your delivery).

To cancel a Contract, you must inform George Fry Ltd. You will then be contacted to agree a method for returning the product(s). Product(s) must be returned in the same condition in which you received them. If you return product(s) in person or send them they will be at your risk until they are received by us. You have a legal obligation to take reasonable care of the product(s) while they are in your possession. If you fail to comply with this obligation, we may have a right of action against you for compensation. We may also charge you a reasonable sum as reimbursement for any missing items such as leads or remote controls.

If you need to return product(s) because you are a consumer and have cancelled the contract within the fourteen working day cooling-off period, you will be responsible for the cost of returning product(s) to us or, where applicable, of us collecting them from you.

Upon receipt of the product, we will refund the price of the product(s) in full, including any initial delivery charges, less the cost(s) we incur in collecting the product, and replacing any missing item(s) or accessories. We will process the refund due to you as soon as possible and, in any case, within thirty days of the day we take receipt of the product(s).

If you are returning product(s) that are faulty, you will not be responsible for any collection costs. You will need to contact George Fry Ltd and we will initially look at resolving the issue. If this is not an issue that we can resolve, and the product is less than 28 days old, then the product can be returned, at our cost, and you will receive a full refund. However, if any accessories are missing, the cost of these will be deducted from your refund.

Details of this statutory right, and an explanation of how to exercise it, are also provided in the sale confirmation. This provision does not affect your statutory rights.

Price

The price of any product(s) will be as quoted on this site from time to time, except in cases of obvious error. These prices include VAT but exclude delivery costs and any other additional services you may have opted for e.g installation, old product disposal etc.

Prices are liable to change at any time, but changes will not affect orders that are the subject of a sale confirmation.

This site contains a large number of product(s) and it is always possible that, despite our best efforts, some of the product(s) listed may be incorrectly priced. Prices will normally be verified as part of the dispatch procedures so that, where the correct price is less than the stated price, you will be charged the lower amount. If the correct price is higher than the stated price, you will be contacted for instructions before dispatching the product(s) and you may then cancel your order if you wish. If you do not cancel your order the product(s) will be supplied at the higher price. We are under no obligation to provide product(s) to you at the incorrect (lower) price, even after we have sent you a sale confirmation, if the pricing error is obvious and unmistakable and could have reasonably been recognised by you as a mis-pricing.

Payment

All payments must be in UK Pounds Sterling.
